Legally binding version of our terms & conditions

BlueBottle GmbH is incorporated in Germany. Our terms and conditions are therefore written in German. This translation is not legally binding. You can find the legally binding version here.

1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded with

Registered in the Commercial Register under HRB 291684 at the District Court of Munich (hereinafter referred to as “BlueBottle,” “the Provider,” “we,” “us,” etc.).

As the supplier/service provider/provider of products, these GTC govern the provision of digital products and services (application for managing content and information).

Any terms and conditions of the customer shall not become part of the contract, even if the customer explicitly refers to their applicability in their order or elsewhere.

BlueBottle (“BlueBottle,” “We,” “Our,” “Company”) develops applications (“Our Products”). The BlueBottle website https://bluebottle.gg (the “Website”), all other products and services, including desktop applications (the “Application”), and all content offered as part thereof, are collectively referred to herein as “Services” and are provided to you by BlueBottle. Our products offer content, functionalities, and services, including but not limited to viral, embedded, or application/device-based features and related technology, whether accessed via the internet, mobile, or other devices (collectively, “Our Services”). Subscribers, account holders, customers, users, and others who download, access, use, purchase, and/or subscribe to the Services (“You”) agree to these General Terms and Conditions (the “Terms and Conditions”). By agreeing to these Terms and Conditions, you confirm that you are solely responsible for your health condition. These Terms and Conditions govern your use of the Services and are a prerequisite for their use.

By using our products and services, you accept these Terms and Conditions. If you do not accept these Terms and Conditions, you may not use our products and services. BlueBottle reserves the right to amend these Terms and Conditions at any time without prior notice. An updated version of these Terms and Conditions will be available on the official BlueBottle website. All changes take effect immediately upon publication. By continuing to use our products, you agree to the amended Terms and Conditions.

2. Orders; Contract Conclusion; Delivery; Service Handover Point

2.1 Contracts for Digital Products

2.1.1 By placing an order, the customer submits a binding offer to conclude a contract under these GTC. This applies regardless of the type and form of the order process (internet, email, fax, telephone, letter, order form, etc.). For electronic orders (internet, email), the customer receives an electronic confirmation summarizing the order details, including the price(s).

2.1.2 The contract is concluded only upon explicit acceptance of the offer by BlueBottle. Acceptance is indicated by the confirmation receipt unless otherwise stated. Acceptance also occurs when the service begins. The contract text is stored after conclusion and can be retrieved by the customer from BlueBottle.

2.1.3 If available, the ordered goods or services will be delivered or provided promptly.

2.1.4 The customer must be at least 16 years old, as the services and products offered are not suitable for children. By using this website or application, you agree to these Terms and Conditions. If you do not agree, you may not use this website or application. If the consent of a legal guardian is required, the minor customer confirms that such consent has been obtained.

2.2 Offered Services

2.2.1 League Broadcast – The application generates overlays and statistics for esports video games.

2.3 Service Handover Point and System Requirements for Internet-Based Services

2.3.1 The service handover point for internet-based services is the router exit of BlueBottle’s data center. The customer is responsible for internet connectivity and network access components.

2.3.2 BlueBottle is not responsible for the customer’s system environment. The customer must ensure they meet the technical requirements specified in the offer.

2.3.3 BlueBottle takes measures to protect against viruses and malware but does not guarantee that downloaded files are virus-free. The customer is responsible for using antivirus software. BlueBottle is not liable for damages from virus transmissions.

3. Refund Policy

3.1 You have the right to withdraw from a digital content purchase agreement within 14 days..

4. Customer Account; Access to Online Products

4.1 Online services require a registered customer account.

4.2 Registration requires providing the necessary information. BlueBottle may reject registrations based on inaccurate data, poor credit history, or fraudulent behavior.

4.3 The customer must keep their account credentials confidential. BlueBottle employees will never request passwords. If misuse occurs, BlueBottle may suspend the account.

5. Payment Terms, Prices, and Price Increases

5.1 Invoices are payable upon receipt. Discounts are not permitted. Late fees may apply.

5.2 Payments processed via Paddle.com Market Ltd. are subject to their terms.

5.4 Prices include applicable VAT.

5.6 BlueBottle reserves the right to adjust prices appropriately.

5.8 Subscriptions renew for the same period unless canceled in advance.

6. Retention of Title

Goods remain the property of BlueBottle until full payment is received.

7. Copyrights and Usage Rights

Customers receive the right to use services per legal requirements. Copyright markings must not be altered. Intellectual property remains with BlueBottle.

8. Warranty

8.1 Consumers have statutory warranty rights.

8.2 BlueBottle may choose to repair or replace defective goods. If the repair/replacement fails, the customer may withdraw from the contract or request a price reduction.

9. Liability Limitations

9.1 BlueBottle is not liable for the accuracy or usability of service content.

9.2 Liability for slight negligence is limited to breaches of essential contractual duties.

9.5 BlueBottle is not responsible for service disruptions due to software, hardware, or third-party network failures.

10. Data Protection

BlueBottle complies with German and EU data protection laws.

11. BlueBottle's Rights

BlueBottle reserves the right to suspend or delete accounts violating these Terms and Conditions.

12. Jurisdiction & Applicable Law

German law applies. Consumers retain protection under their country’s mandatory laws.

13. Alternative Dispute Resolution

The EU provides an online dispute resolution platform: http://ec.europa.eu/consumers/odr. BlueBottle is not obliged to participate in such procedures.
